The contribution deals with most important elements of an enforceable Notarial Act with an emphasis on the consent of a person regardin direct enforceability and the role of a Notarial Act for the securement and strengthening of the obligation. The author draws attention to additional duties of a notary in regard to real estate transactions and also to other elements for ensurement of legal certainty. Also shown are possible disadvantages of Notarial Acts and ways of their elimination by lawsuit or in a civil enforcement procedure.

COBISS.SI-ID: 249555456The author deals with two ways for establishing of apartment ownership on the basis of a judicial decision in non-contentious civil proceedings. The first is regulated in the Property Code and the Non-Contentious Civil Procedure Act. It is open for individual co-owners of immovable property in cases, where no consent about the transformation of co-ownership to apartment ownership between the co-owners can be reached. The second procedure has been introduced by the Act on the establishment of apartment ownership upon request of an acquirer of an individual part of a building (ZVEtL).
