Elements of the Philosophy of Right (Grundlinien der Philosophie des Rechts) is considered to be a fundamental work on practical and, more specifically, political philosophy. In it Hegel elaborates a systematic concept of right, as an “existence of freedom”, and elucidates conditions – formal, moral, and ethical –, in order for the “free will” to actualize its freedom. Hegel’s philosophy od right is a critique of Kant’s morality – which he reproaches as being non-actual and arbitrary –, and against it, Hegel stresses the “ethical life”, Sittlichkeit, which combines ethical, social, public and historical objectivity that makes a subject to what it really is.

For Luhmann, society is the condition of possibility of power, which means that Luhmann offers a theory of power by way of a theory of society. Power is regarded as a symbolically generalized medium of communication. Luhmann’s theory thus withdraws from the traditional „classical theory of power“, since it does not understand power according to the formula of causal connection, physical constraint, hierarchy ascribing power to those on top, or the constant-sum-principle.
