The article discusses conflicts that arise between traditional models of collective management of copyright and related rights and the emergence of the Internet as a channel for distribution of creative works in a digital form. The European Commission is promoting the possibility of a unified rights management for online use of works on the EU level. The author's autonomy is limited by rules on mandatory collective rights management. Collective societies' rules prevent their members from free licensing some of their works, which prevents authors from using the full potential of the Internet.

The system of immunity from fines and the reduction of fines to parties of anti-competitiveagreements or concerted practices which have as their object or effect the prevention, restriction or distortion of competition, is primarily aimed to uncover and put an end to cartel business practices and their negative consequences. The article analyzes the Slovenian leniency programme which was modelled upon the Leniency Notice of the European Commission. The author detects certain factual and legal deficiencies which are yet to be abolished for the system to work effciently and attain its goals.

Owner of real estate enjoys protection against excessive immissions effecting his real estate from other real estates. The law of property preserves classical regulation of protection by the negatory action.The Code of Obligations has similar provision in the realm of torts law. Legal rules have not followed the technological development and do not pay regard to a possibility of measuring some immissions. Public law provisions on immissions' threshold values should be considered in the realm of private law protection; prohibition claims should not be used for generally beneficial activities.
