The EU Services Directive (SD) is a centrepiece for the realisation of the Internal Market in the services sector aiming at considerably lowering the barriers for service provision in the EU. This chapter therefore analyses the transposition and implementation of the requirements of the SD into the national (administrative) law system of Slovenia. This chapter treats all relevant requirements of the SD, such as the Point of Single Contact (POSC), the screening of national law according to the requirements of the SD, the adaption of authorisation schemes for service provision, the requirement of ‘tacit authorisation’, and the need for new rules on administrative cooperation. Finally an assessment of the impact of the SD on the national (administrative) law system is provided.

In the pursuit of justice, truth always plays a prominent role. Few if any legal systems are willing to waive the right to claim that the results of their legal processes are fair, just and above all based on the truth. In most legal systems, elaborate rules on the taking of evidence try to guarantee that an accurate, factual basis is used for the application of the law. The present volume focuses specifically on the rules of evidence within the context of efficiency in civil proceedings. All legal systems must find the right balance between the amount of time and money invested in the civil trial and the thoroughness of the proof-taking stage in litigation. Obviously, a system of proof that can produce trustworthy results is in need of considerable investment of time and resources, but the amount of time available and resources is not without its limits. If a proper balance between truth and the necessary time and resources cannot be found, the whole process of litigation may be endangered.

This article covers all the most relevant aspects of judicial expertise in the field of land surveying. It is focused on non-contentious civil procedures for the regulation of boundaries, for the division of common property, enforcement procedure for the division of property. Among them, the problems of division into divided co-ownwership were also taken into consideration. The author explains how the judge and the expert co-operate in the public hearing or outside of it issue a court decision that is (together with expert's specific input) apprpriate for inscription into the cadastre. Un case of division of land with parcelling or in the case of division into a condominium, a further inscription into the land register is necessary. The advantage of this contribution is author's taking a position on disputed questions in relationship between the legal and land surveying professions, by taking into consideration the legal sources from both sides.

The Great commentary contains a detailed commentary of individual articles of ZGD-1. It includes all the modifications of the act, including the amendment ZGD-1H, Official Gazette RS, No. 82/2013. The commentary includes relevant case law and has a detailed subject index. The commentary is significantly updated due to an increased number of legal provisions and numerous changes, and especially due to systematic inclusion of extensive relevant case law of the Supreme Court of the RS and of higher courts. The emphasis of the comments is comparison and appropriate reference to comparative legislation (mainly German in AktG and Austrian). The commentary is designed as a scientific work, but is with discussion and explanation of specific institutes intended mostly for legal practice, both judiciary and business, legal, economic and management science. As additional literature, it will also be used for undergraduate and post-graduate study, mostly of law, economy and organizational sciences.
