In this article the author describes the characteristics that apply in the field of environmental protection regarding the direct applicability and direct effect of its provisions. Because the environment can not be an active entity in administrative and judicial proceedings there is no need for the criterion of Human Rights, otherwise known as a condition for direct effect of the provisions.
