The ten new Member States of the EU were exposed to a greater degree of Europeanisa-tion than any previous accession country. There are several reasons for that. The power-asymmetry, time pressure to adopt more than 80,000 pages of the common EU acquis, the conditionality of the administrative capacity requirement, and openness of CEE élites to EU influence. The EU imposed quite a strong form of administrative capacity conditionality in the case of civil service reforms. Nonetheless, we should not underestimate the impor-tance and role of domestic CEE élites in the process of Europeanisation.

Author's main objective is to analyze the systematic characteristics of the Unfair Commer-cial Practices Directive and its nature as to the scope and its respective place in the body of European law. He presents the recent case law of the European Court of Justice concerning the directive and its impact on national law. The liability of producers in the Slovenian law is subject to two different regulations without de-limitation: Articles 1 and 4-1 la Consumer Protection Act and Article 155 of the Obligations Code.

The use of various forms of alternative dispute resolution outside classical judicial procedures is grow-ing in Europe. These include especially the mediation and conciliation and, in a wider sense, also the arbitration. These procedures can facilitate access to justice for individuals and are appropriate for easier resolution of cross-border disputes in the single European market. For this reason, the EU de-mands that Member States encourage the use of such procedures, and promotes the self-regulation of the bodies, dealing with out-of-court dispute resolution.
