The chapter in the book, published by a renouned publishing house, questions the future developments in sentencing and punishment. In it the authors discuss the relationship between subjectivity and objectivity in criminal justice, especiallly with regard to the use of algorithms as aids in criminal justice decision making. Even though such progress might be beneficial in many ways, there are numerous obstacles and dangers on the way to an improved criminal justice systems, and such concerns do not receive enough thougt in contemporary debates.

The chapter describes in detail the juvenile justice system in Slovenia which is in turn compared to different systems in the world. Juvenile justice is one of the lakmus tests used to ponder a given systems' punitivity levels. With regard to this, Slovenia turns out to be extremely non-punitive in the area of juvenile justice. The book is a new edition of one of the most notable comparative studies in juvenile justice and is a main source for studying these issues.

The paper focuses on the implementation of community service as an alternative form of punishment in Slovenia. In the first part, it focuses on the legal framework in a historic prespective of community service in Slovenia (the researcher authored that part of the article) and presents the actors implementing community service. The second part includes the results of the preliminary study on community service as a form of alternative sentencing in the Ljubljana region.

The question of sentencing procedure, the part of the criminal procedure specifically poised to determine the circumstances relevant to producing a just sentence, is important as it may (at least partly) determine the outcome. The paper questions some of the more important issues with regard to different systems of sentencing procedures. The key difference between common law and continental systems, the question of a bifurcated or a uniform procedure, with or without the separation of the verdict and sentencing phases, are most thoroughly analysed. However, other issues seem relevant as well, such as the question of standards of proof, the judgment’s substantiation, and of legal remedies.
