Abstract
The research is based on a principle of lawyer’s active role in determining the law. The lawyer is an expert source of the law and is thereof responsible. The arising moral question of responsibility is not merely a personal question; the constitutional legal framework is to guarantee a status and role that provide to for lawyers the possibility of autonomous and expert work based on legal tradition (e.g. Art. 3/2 Law on Courts). Furthermore: this status and role are in a certain way the far horizon that law can touch. This research aims at being one of the fragments of the mentioned horizon. The goal of the research is to add new dimensions to understanding law (generally and in the field of civil law). The understanding of static and dynamics of law is a basis that co-determines our understanding and realization of law.
